IPPNY Statement on DEC Denial of Title V Permits

Albany, NY – Today, the New York State Department of Environmental Conservation (DEC) announced its decision to deny Title V Permits for the Danskammer Energy Center and Astoria Gas Turbine Power, LLC.

IPPNY President and CEO Gavin J. Donohue said, “IPPNY Members support the long-term goals of the Climate Leadership and Community Protection Act (CLCPA) and the development of zero-emitting technologies, including renewable resources and energy storage, to meet those goals. The State needs a path forward to encourage necessary investment to meet the CLCPA’s targets. The DEC’s decisions to deny permits sends a chilling signal that the business climate needed to develop technologies is at risk, and today’s decisions by the DEC are simply short-sighted and bad public policy.

“Contrary to the DEC’s statements, the denial of these repowering permits is inconsistent with the progress needed to achieve the CLCPA’s targets over the next 20 years. Projects, such as Danskammer and Astoria, displace significant emissions from existing resources while ensuring that New York City and the rest of the State can maintain reliability while the energy system transitions to a low carbon future. The Climate Action Council has received information from New York State Energy Research and Development Authority and the New York Independent System Operator that demonstrates the need for flexible, dispatchable resources – like Danskammer and Astoria – in order to reliably meet the CLCPA’s goals.” 

The DEC has not provided guidance for how permit decisions will be made under the CLCPA. While the decision-making processes of the Council and the DEC play out, it is important to embrace opportunities to reduce emissions in the near term. These air emission reductions proposed by Danskammer and Astoria would assist the State in progressing toward CLCPA compliance.
